Can a notary do a power of attorney?
No. Our notaries are not licensed attorneys and cannot draft legal documents on your behalf.
Our role in the process is just to properly identify each signer and witness the signatures from all parties. (which must be done willingly for PoAs)
Power of Attorney Witness Requirements
In 2021 the NYSBA updated the the laws affecting PoA documents in New York State.
Generally, 2 witnesses are required in NY. The statutory form requires both witnesses to sign, print their full names, and full address.
The person taking the acknowledgment can also serve as a witness (that would be one of our notaries!).
